The FY2026 National Defense Authorization Act is the annual defense policy bill that sets military spending priorities and authorities. It passes every year - making it the most reliable vehicle for Ukraine-related provisions. Key Ukraine provisions being pushed for inclusion include continued Ukraine Security Assistance Initiative (USAI) funding, intelligence sharing authorities, and prohibitions on recognizing Russian-occupied Ukrainian territory as Russian sovereign territory.
Ukraine Security Assistance Initiative Funding
Annual USAI funding authorizes the Pentagon to provide weapons, training, and equipment to Ukraine's armed forces. The FY2025 NDAA included $300 million; advocates are pushing for at least the same level in FY2026.
No-Recognition Provision
A provision prohibiting the U.S. government from recognizing Russian sovereignty over any Ukrainian territory - including Crimea, Donetsk, Luhansk, Zaporizhzhia, and Kherson - would prevent any executive branch action that implicitly legitimizes Russian occupation.
Intelligence Sharing Authorities
Expanded authorities for the intelligence community to share classified information with Ukrainian counterparts, including targeting data and early warning of Russian missile and drone attacks.
Sanctions Enforcement Requirements
Provisions requiring the Treasury and Commerce Departments to report to Congress on sanctions enforcement actions against Russia, closing accountability gaps in the current regime.
The NDAA passes every year - it has for 63 consecutive years. Getting Ukraine provisions into the NDAA is the most reliable way to lock in support that can't be reversed by executive action alone. The window to influence what goes into the FY2026 NDAA is now, during committee markup season. Members of the Armed Services Committees are the key targets.
